1. Agreement to Terms
By accessing or using NoizeBay’s services, you agree to these Terms and our Privacy Policy. If you do not agree, you must stop using our platform.
2. Services Provided
NoizeBay provides digital music distribution services including, but not limited to: distribution to platforms such as Spotify, Apple Music, JioSaavn, YouTube Music and other streaming services, content licensing, and monetization solutions for independent artists and labels.
3. Eligibility
You must be at least 18 years old to use our services. By using NoizeBay, you confirm that you have the legal authority to enter into this agreement and that all information you provide is accurate.
4. User Responsibilities
- Content Ownership: You must own the full rights to the content you upload or have legal permission to distribute it.
- Licensing: You grant NoizeBay the right to distribute and monetize your content across multiple platforms (including Content ID services).
- Compliance: You agree not to upload any illegal, copyrighted, or infringing material.
5. Payment & Royalties
- Payment Structure: Royalty payments are based on earnings generated from your distributed content.
- Royalty Share: You will receive a percentage of net revenue as communicated at the time of registration.
6. Content Monetization
NoizeBay may use YouTube Content ID and other digital rights management services to track, protect, and monetize your content. You provide full authorization for this action.
7. Termination
Either party may terminate this agreement at any time. After termination, NoizeBay will stop distributing your music, however any earned royalties up to that date will still be paid according to schedule.
8. Limitation of Liability
NoizeBay shall not be responsible for any direct, indirect, incidental, or consequential damages. While we take security seriously, we cannot guarantee total protection against piracy or misuse.
9. Intellectual Property Rights
You remain the full owner of your intellectual property. By uploading content, you grant NoizeBay a non-exclusive, worldwide license to distribute, monetize, and license your content on your behalf.
10. Artificial Streaming Policy
All users must strictly follow organic streaming practices and must not use any artificial methods to increase streams or engagement.
10.1 Prohibited Activities
- Fake streams, bots, click farms, or software-generated plays
- Paid follower services or automated activity
- Unauthorized third-party promotions
10.2 NoizeBay Liability Disclaimer
- NoizeBay is not responsible for penalties enforced by DSPs (Spotify, Apple, YouTube, etc.)
- Violations may lead to takedown, demonetization, and legal action by platforms
10.3 Financial Liability & Penalty

The party responsible for the upload (Artist, Label, Distributor) will be liable for:
➤ 100% of the platform penalty
➤ 20% service charge payable to NoizeBay
➤ 18% GST on the total amount - Payment must be completed within the given deadline
10.4 Legal Consequences
- Non-payment may result in legal action
- Permanent account suspension
- Reporting to streaming platforms
10.5 Platform Policy Compliance
- Users must follow the individual terms of every DSP
- Only organic and legal promotion methods are allowed
By using NoizeBay, you confirm that you have read, understood, and accepted this policy.
11. Modifications
NoizeBay reserves the right to modify these Terms at any time. Updates will be posted on this page. Continued use means acceptance.
12. Governing Law
These Terms shall be governed by the laws of Uttar Pradesh, India. Any disputes shall be resolved in courts located in Uttar Pradesh.
